Recently, there has been an increase in the number of custody cases that involve pets in divorce cases.

In a 2006 survey, it was found that the number of custody cases that determine the fate of a pet has grown nearly 15 percent. Attorneys have stated that the court tends to lean toward leaving the pet with the child if there is a child, but in cases where the pet is considered the child to the couple, it becomes a more difficult situation.

In the past, pets have been considered to be more of property, but now they are seen as children. Also, there are currently no laws that state how visitation will work for with pets so it is left up to the split couple to discuss.
